Michael Jordan Testifies He ‘Wasn’t Afraid’ of the Racing Body in Legal Battle
The basketball icon, as he cordially introduced himself in a federal courtroom on Friday, stated that his competitive side and status as a newcomer motivated his push for 23XI Racing to confront Nascar over perceived violations of antitrust rules.
Team Investment and a Will to Win
Jordan shared operational insights of his racing venture, revealing he invested $40m of his own funds into the Cup Series operation co-founded with partner Polk and longtime driver Denny Hamlin.
“It fell to someone to act,” Jordan stated in the Charlotte courtroom. “I was a new person, I wasn’t afraid. I believed I could take on Nascar in its entirety. From my perspective, the sport required examination from a different view.”
The Core Dispute: Franchise System and Renewal Demands
The heart of the case involves the expiration of a 2016 agreement where Nascar provided each team a “charter”. The concept is similar to other major leagues with independent franchises, like the NBA’s Hornets or the NFL’s Panthers. The agreement was due to end in 2024 when Nascar insisted on charter membership renewals.
Jordan was on the witness stand for about sixty minutes and exited the courthouse to pandemonium, with onlookers and reporters clamoring for a glimpse or a picture of the sports legend.
Leading the Legal Charge
23XI Racing is at the forefront of the push along with another racing team for Nascar to overhaul a operating model Jordan contended is breaking the law to maintain excessive control.

Heather Gibbs’ Testimony
Gibbs described her push for indefinite franchises, which she said a formal letter to Nascar. She testified the pressure of the contract signing demand was problematic.
She said, Joe Gibbs first tried to call and talk Nascar out of forcing signatures, but CEO Jim France refused the appeal.
“Don’t do this to us,” Heather Gibbs said Joe Gibbs told Nascar’s leadership. The response was, “If I wake up and I have 20 charters, I have 20. If I have 30, that’s the number.”
